The EXPCON Canada 2023
Terms and Conditions

Acceptance of policies and registration conditions

Thank you for registering for EXPCON Canada 2023 (the “Conference”). Regardless of whether your registration is submitted by you or your proxy, the following Conference Terms and Conditions (these “Terms”) apply to you and your participation in any eXp Conference (both in-person and virtual). Depending on the type of conference, certain terms below may not apply. “Attendee(s)” for purposes of these Terms will include all participants at the Conference, including exhibitors, speakers, sponsors, vendors, and attendees. By registering for or by attending this Conference, you agree to these Terms so please read them carefully. Should you not wish to accept these Terms herein, you should not register for or attend this Conference.  Submission of a registration is regarded as affirmation of your acceptance of these Terms.  These Terms include and incorporate by reference eXp’s Global Privacy Policy. To the extent there is any conflict between these Terms and eXp’s Global Privacy Policy, these Terms will prevail. This Conference is organized by eXp World Holdings, Inc and its affiliates and subsidiaries (“eXp”). eXp reserves the right, in its sole and absolute discretion, to limit or deny access to any entity or individual for any time and for any reason, without refund.

Conference Registration

Ticket Refund Policy

Refunds for Conference ticket purchases will be issued only if a refund request is made through the hyperlink provided on your electronic ticket confirmation receipt by not later than Tuesday, August 15, 2023, 11:59pm EST (the “Refund Deadline”). Refund requests received after the Refund Deadline will not be honored. Refunds will not be issued for nonattendance at Conference.

Registered Ticket Holder Substitution and Badge Policy

Each registered ticket holder must obtain a Conference badge in order to be admitted to Conference. Conference badges are issued to, and can be picked up and used only by, the registered ticket holder named in the registration. Admittance to Conference may be denied if any Attendee’s name as reflected on a Conference Attendee badge does not match the registered ticket holder’s name as registered with eXp. Sharing of Conference attendee badges is not permitted. Photo identification will be required for each Attendee when picking up a badge onsite. Badges must be worn at all times during Conference.

Each Conference ticket is transferable. Transfers may be made at any time up to the day immediately preceding the start date of Conference. Transfers may only be made through the hyperlink provided on your electronic ticket confirmation receipt and will require the entry of the transferee’s name and contact information into eXp’s registry.

eXp does not preclude the resale of your Conference ticket to another person. In doing so, you must adhere to the transfer terms described in the preceding paragraph. Failure to update the new ticket holder’s name in eXp’s registry may preclude that person from obtaining a Conference badge issued in their name. Consequently, they may be denied admission to the Conference. If you sell your ticket, you take all responsibility for exchanging funds and ensuring that the new ticket holder’s name and contact information is timely and correctly entered into eXp’s registry.

Invitations that are part of an invitational program are non-transferable and are not eligible for resale.

A Conference badge allows an Attendee entry to the overall conference, but does not guarantee admission to every session, lounge, or meeting area. Admission is subject to venue capacity and other requirements. Certain sessions may be restricted by vendor attendees.

International Attendees

All payments are processed in U.S. Dollars. International currencies are converted to U.S. Dollars on the date of payment. eXp makes every effort to process the most accurate currency exchange. However, all international payments are subject to fluctuation in currency exchange rates.

Force Majeure

After the Refund Deadline, payments made are not refundable for any reason, including, but not limited to, failure to use conference attendance credentials due to illness or due to any event beyond the reasonable control of the parties, such as an act of God, national or global epidemic, natural disaster, travel-related problems or an act of terrorism.

Use of Personal Registration Information

By registering for the Conference, you grant eXp the right to use your personal registration information, including your name and email address, which eXp may, in its sole discretion, use to provide you direct communications from eXp about the Conference, including communications about event sponsors, vendors, speakers, or other event details. By registering for the Conference, you authorize eXp to share your name, registration status, and personal registration information with the Revenue Share Group to which you belong, as well as with your state broker team, for the purpose of receiving additional event details.  eXp operates in the United States and will transfer your personal registration information to the United States for the purposes outlined in these Terms. By registering for the Conference, you consent to your personal registration data being transferred to the United States. Please note that your personal registration information, including responses to the optional demographic questions, is not shared with any event sponsors or other vendors for marketing or advertising purposes. Age and gender identity information is only used internally by eXp personnel with a need to access such information to perform their business duties. eXp deploys technical, organizational, and systematic controls designed to prevent unauthorized access, destruction, alteration, or misuse of your personal registration information.

Event Conduct and Safety

eXp is committed to providing a safe, productive, and welcoming environment to all participants, including staff and Attendees, at eXp-related events. eXp has no tolerance for discrimination, harassment, or bullying in any form at eXp-related events. Participants including staff and Attendees are expected to adhere to these principles and respect the rights of others.

Nondiscrimination Policy

eXp prohibits discrimination, harassment, and bullying against any person for any reason—for example, because of age, ancestry, color, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, veteran status, or any other characteristic protected by law. Any such behavior on the part of any Attendee will constitute grounds for immediate removal from the Conference.

What To Do If You Witness or are Subjected to Unacceptable Behavior:

Attendees should report any behavior inconsistent with these principles to onsite event staff. Event staff will be happy to help Attendees contact venue security or local law enforcement, provide escorts, or otherwise assist those experiencing harassment to feel safe for the duration of the event. We value your attendance. You may also contact eXp directly to report a concern at [email protected].

Covid-19 Measures

In the effort to mitigate the risks associated with Covid-19, eXp will fully comply with all applicable Covid-19 rules and regulations, including but not limited to those promulgated by federal, state, province, county, district, and city authorities, and those promulgated by Conference location.

Liability Waiver & Release

In consideration of being allowed to register for, and participate in the Conference, you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue eXp or its members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to COVID-19, injury, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of eXp. This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.

Credential/badge Scanning During the Event

Conference, co-sponsors, exhibitors, and other third parties may directly request your personal information at their exhibit booths or presentations.  Providing your information to them is optional, and you should review their privacy policies to address your particular needs and concerns about how they will treat your personal information, including their practices for international data transfers.

If during the event you attend a session or program hosted by an exhibitor other than eXp, you understand and agree that when you present your badge for scanning or when you provide personal data, that information will go to a non-eXp entity and eXp takes no responsibility for how that company uses your personal information, including the countries they may transfer personal information to while it is in their possession.

Promotional Policy

Attendees may not promote any competing products, services, companies, or events at the Conference or to Conference Attendees either on or off the event property without permission from eXp. Entities or Attendees found to be in violation of this policy may be expelled from the Conference without a refund at the sole discretion of eXp. Distribution of flyers, pamphlets, notices and brochures in any session of the Conference, without the prior written consent of eXp, is expressly prohibited.

Usage of photographic and video material taken at eXp events

To comply with global data privacy laws, eXp imposes certain restrictions on the use of multimedia at its events (e.g. photography, video, audio, online streaming, and all future mediums).  Attendees are permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever.

eXp may hire professional service providers (photo/video/streaming/audio) to document and display the event experience.  eXp may also use social media (e.g. Twitter) to: (i) post real-time photos and videos to its social media feeds; and (ii) display select submissions from those feeds on monitors throughout the event venue.  Attendees are encouraged to capture their event experiences and post their own social content from the event (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any Attendee, third party, or eXp.  Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights.  In the event an Attendee requires a release or permission to protect the rights of a third party, obtaining such a release or permission shall be the sole responsibility of the Attendee.

By attending the event, you acknowledge and agree as follows: (a) eXp may edit and use footage it captures at the event for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of mobile recording devices in today’s world, eXp disclaims all liability for the capture of your image in any multimedia format by other Attendees at the event.

General

eXp reserves the right to change, amend, add or remove any of the above Terms in its sole discretion and without prior notice. If one or more of the conditions outlined in these Terms should become invalid, the remaining conditions will continue to be valid and apply. These Terms apply to all Attendees.

The views expressed by any event Attendee are not necessarily those of eXp.  All Attendees are solely responsible for the content of all individual or corporation presentations, marketing collateral, and/or advertising.

Exhibitor Endorsements

The ideas and opinions offered at exhibitor sessions presented during this Conference are solely those of the speakers and do not necessarily reflect the position, policy or opinion of eXp. The ideas and opinions presented in any exhibitor session and the products and services displayed by Exhibitors at the Conference should not be construed as a recommendation or endorsement of the ideas, opinions, products or services by eXp. In issues affecting legal, financial or accounting matters, members should also consult trained professionals to address their individual situations.

Conference Cancellation Policy

eXp may, in its sole and absolute discretion, cancel the Conference at any time and for any reason. If such cancellation occurs prior to the Refund Deadline, Attendee ticket purchases may be refunded according to the applicable provisions herein. If such cancellation occurs after the Refund Deadline, eXp may issue refunds according to its sole and absolute discretion.
